Tucson Appeals Lawyer

The criminal justice system is not perfect. However, there are remedies available when mistakes and errors occur. It is crucial though to seek out an experienced appellate attorney who understands how to argue these motions and technical research involved with these applications.

I am Kevin Oursland, and I have been pursuing post-conviction matters and appeals since becoming a criminal defense attorney. As a Tucson appeals lawyer, I am admitted to practice in all Arizona state courts, as well as the Nebraska Supreme Court, the U.S. District Court and the Eighth Circuit Court of Appeals. I offer free initial consultations to review your case.

I handle state appeals where the following issues are present:
  • The judge made improper rulings
  • There was insufficient evidence for a conviction
  • If the sentence handed down is excessive
  • Ineffective assistance of counsel
At the trial level, it is possible to appeal both the conviction and the sentence. However, if you accepted a plea bargain, you may only appeal the sentence. I will review the entire record of your case to see if procedures were followed correctly and if your prior lawyer explored every option. This may include if you were denied a right to an appeal because your original attorney did not file a timely notice of appeal. In this case, I can petition a post-conviction relief motion that highlights these grounds.

In addition to pursuing an appeal or post-conviction ruling on your behalf, I can also assess if you may qualify for an expungement, depending on the crime and your record. I will carefully explain this administrative process to you and handle all the paperwork on your behalf. If successful, your record will be wiped clean of the offense and taken off of publicly searched databases.
