Arrested for Assault? Contact Lincoln Attorney Kevin J. Oursland
Assault charges often involve alcohol. Fights can break out in a bar or other setting after one or both parties had been drinking. The fight can become a criminal matter if one of the parties is injured.
As a former state prosecutor and a defense lawyer with more than 13 years of experience in assault cases, I know how to evaluate the strengths and weaknesses of the state's evidence against you. I offer a free initial consultation to discuss your case.
I defend people charged with all types of violent crimes, including:
- Assault and aggravated assault
- Strangulation
- Terroristic threats
- Stalking
- False imprisonment
- Manslaughter
- Murder
Consequences of an Assault Conviction
Any offense against a person is a serious matter. There are three degrees of assault in Nebraska:
| Charge | What it involves | Penalty |
| First degree assault | Serious bodily injury | Up to 20 years in prison |
| Second degree (or aggravated) assault | Injury caused by use of a deadly weapon such as a knife or a baseball bat | Up to 5 years in prison |
| Third degree assault | Any bodily injury, however minor, that is intentional | Up to 1 year in prison |
Even if you are offered probation, any assault conviction will result in a permanent criminal history.
Defending You Against Assault Charges
There are two sides to every story, and one of the things I will do as your lawyer is ensure that your side of the story is told.
Self defense and the defense of others are defenses in assault cases. If you have an explanation for the fight, that can also be used to mitigate sentencing. In addition, the judge is always more likely to consider a lesser sentence if you seek anger management or alcohol treatment.
