Consequences of an Assault Conviction

Any offense against a person is a serious matter. There are three degrees of assault in Nebraska:

Charge What it involves Penalty
First degree assaultSerious bodily injuryUp to 20 years in prison
Second degree (or aggravated) assaultInjury caused by use of a deadly weapon such as a knife or a baseball batUp to 5 years in prison
Third degree assaultAny bodily injury, however minor, that is intentionalUp to 1 year in prison

Even if you are offered probation, any assault conviction will result in a permanent criminal history.

Defending You Against Assault Charges

There are two sides to every story, and one of the things I will do as your lawyer is ensure that your side of the story is told.

Self defense and the defense of others are defenses in assault cases. If you have an explanation for the fight, that can also be used to mitigate sentencing. In addition, the judge is always more likely to consider a lesser sentence if you seek anger management or alcohol treatment.
