Consequences of a DUI Conviction
The penalties for a DUI conviction will depend on whether you have prior convictions and whether your blood alcohol content was between .08 and .15, or higher than .15.
A DUI conviction has significant personal consequences, such as fines, the potential for jail time, suspension of your driver's license, and the need to pay high-risk insurance once your driving privileges have been reinstated.

Time is of the essence. In Nebraska, you will lose your driving privileges through the Administrative License Revocation (ALR) process for 90 days—one year if you refuse to submit to a chemical test—unless you submit the necessary paperwork to the Department of Motor Vehicles within 10 days of your arrest.
Defending You Against DUI Charges
Drunk driving is one of the most difficult criminal cases to defend properly. There are several technical issues that arise in a DUI case, such as:
- Whether the police officer had a valid reason for stopping you and probable cause to arrest you.
- Whether the field sobriety tests were properly administered.
- Whether the breathalyzer machine was properly calibrated and the police officer was trained in its use.
I will investigate these types of technical defenses. If the police officer made mistakes, I will file a motion to suppress the state's evidence against you.
If this is your first offense, I can seek to have the DUI charge reduced to reckless driving. The state is always more likely to reduce charges if your BAC was close to .08 and you agree to an alcohol evaluation.
