Arrested for Domestic Assault? Contact Lincoln Attorney Kevin J. Oursland
Most people who are charged with domestic violence did not intend to injure their spouse or girlfriend. Rather, financial stress, drinking or another issue led to a fight and somebody called the police. This sets a chain of events in motion. If the police find any evidence that an assault has occurred — such as a mark on someone's cheek or a statement from the victim — someone is going to jail.
As a former state prosecutor and a defense lawyer with more than 13 years of experience handling domestic violence cases, I know how to evaluate the strengths and weaknesses of the state's evidence against you. I offer a free initial consultation to discuss your case.
In some cases, people are falsely accused of domestic violence by a spouse who wants to get the upper hand in a divorce proceeding. If that is the case, we can present a defense showing the motivations of the complaining spouse and the lack of other evidence.
Consequences of a Domestic Violence Conviction
Domestic violence is a class one misdemeanor, punishable by up to one year in jail and a $1,000 fine. The conviction will stay on your record in Nebraska unless it is set aside. An employer conducting a background check on you will see that conviction and may not hire you as a result. If you are a police officer, you will probably lose your job because you will barred from carrying a gun within the city limits.
In a divorce case, a conviction on domestic violence charges could result in you being denied custody of your children.
Defending You Against Domestic Violence Charges
If this is a first offense, pre-trial diversion may be an option. In Lancaster County, you can usually obtain probation after completing a domestic violence course and paying a $25 fine.
If the charges are untrue, I can defend you aggressively. There are two sides to every story, and as your lawyer, I will ensure that your side of the story is told.
